Tax Collector Dariel Fernandez Applauds U.S. Supreme Court’s Cuba Property Rights Decision
Today’s decision by the United States Supreme Court is a powerful victory for justice, accountability, and the fundamental right to private property. For more than six decades, Cuba’s communist dictatorship has attempted to escape responsibility for property it unlawfully confiscated from American citizens and businesses without compensation. The Castro regime did not merely seize buildings, refineries, service stations, and investments, it stole the livelihoods and legacies of countless families and enterprises while expecting the world to look the other way.
Today, the Supreme Court made clear that Cuban government-owned entities cannot automatically hide behind sovereign immunity while continuing to possess, use, and profit from stolen property.
I strongly applaud the Court’s decision to allow the case to move forward. This ruling reinforces the purpose of the Helms-Burton Act and sends an unmistakable message: the passage of time does not erase an injustice, and a dictatorship cannot claim immunity from the consequences of its actions.
This decision is also deeply significant for the Cuban exile community and for every victim of the regime whose home, land, business, or inheritance was taken without due process or lawful compensation. Their claims must not be forgotten, dismissed, or sacrificed for political convenience.
The road toward full accountability is not over. The case will now return to the lower courts, where the claims must continue to be pursued. But today’s ruling represents an important step toward justice and establishes a stronger foundation for holding the Cuban regime and its commercial entities responsible.
The United States must continue standing firmly with the victims of communist confiscation, not with the officials and state, controlled companies that benefit from stolen assets. Property rights are human rights.
